What is a probate proceeding?



When checked, the definition of probate is: the official proving of a will. A probate proceeding occurs after a person has died and the court is in the process of checking their will. This process needs to start in the county where the deceased person lived at the time of their death. The executor of their will (personal representative) is in charge of making sure all their affairs are settled, such as their debts being taken care of.  During the probate proceeding, the executor of the will identifies the deceased person’s property, pays off any debts, sees who will inherit the estate and makes sure they are the ones who inherit it.
