American dream: Rich uncle dies and leaves you a house and a bank account

Based on a True Story

In 2011, I got a call from a client in Moscow. Here is what happened. The client’s uncle (lets name him Sam) died in NY in 2009 and left a substantial inheritance to his nephew in Russia - a house worth $750,000 and a bank account of $250,000. Sam was a financially affluent, childless and unmarried man, and had no other relatives. The question posed by a client was: “how can I get it?”

It was a tricky situation, since the uncle only left a will. If there is just a will, foreign-based relatives must hire a US attorney to probate (validate) the will. According to US laws, each will has to go through probate to become valid, even if no one is objecting to its validity. The probate court’s location must be in the county of uncle’s death. While under probate, all uncle’s assets are frozen by the court: thus, Russian nephew cannot use a house or bank account. It could take up to a year and a half for the process to be completed. The contestants (if any) may question the will on many grounds – was it indeed the last and final will of the decedent, was decedent in sound mind while executing the will etc… Again, I want to emphasize that the will is not valid unless it passes through probate – a process by which the court has to validate it. This process is expensive(and includes court and attorney’s fees) and is impossible to complete without a lawyer.

On the contrary, if the uncle left a trust, nephew would bein luck. If nephew is a beneficiary of the revocable or irrevocable trust, created by an uncle, than nephew would get an inheritance without any legal problems. It would be disbursed tothe nephew by the trustee (or trustees) of the trust, according tohis uncle’s wishes, and right away. Trust would never go to probate. The greatest thing about the trust is that it does not matter if the beneficiary is a US or a foreign national – the assetswill be transferred to him no matter what.

Why am I spending so much time talking about this issue? If you want to leave your assets to somebody abroad, the best way to provide smooth transfer is to go to a reputable attorney, create a trust, and designate your relatives abroad as trust beneficiaries. This way, after your death, your relative would avoid wasting time and money on legal fees and will get everything you want to leave him without any issues.

В 2011 г. мне позвонил клиент из Москвы. Вот что произошло. Дядя клиента (назовем дядю Сэмом) умер в Нью-Йорке в 2009 г., оставив существенное наследство племяннику в России: дом стоимостью в $750,000 и $250,000 на банковском счету. Сэм был состоятельным холостяком без детей и других родственников. Клиент спрашивал меня, как он может получить наследство?

Это была сложная ситуация, поскольку дядя оставил лишь завещание. В случае такого завещания, заграничные родственники обязаны нанять американского адвоката для процесса утверждения завещания (probate). Согласно американским законам, каждое завещание обязательно должно пройти этот процесс, даже если его никто не оспаривает. Суд, который будет подтверждать завещание, должен находиться в стране, в которой скончался автор завещания. В ходе процесса подтверждения, все активы дяди будут заморожены судом – племянник в России не сможет воспользоваться ни домом, ни счетом. А процесс этот может занять до полутора лет. Несогласные с завещанием (если таковые имеются) могут оспорить документ на множестве оснований: было ли это последним завещанием покойного, был ли покойный в здравом уме в момент составления завещания и т.д. Я снова хочу подчеркнуть, что завещание недействительно, если оно не прошло процесс утверждения судом. Этот процесс очень дорогой (включает в себя судебные издержки и гонорар адвоката), и провести его без помощи адвоката невозможно.

А вот если бы дядя оставил после себя траст, племяннику бы повезло. Если бы племянник был бенефициаром отзывного или неотзывного траста, созданного дядей, то он получил бы наследство без каких-либо юридических проблем. Оно было бы передано племяннику попечителем (попечителями) траста, согласно пожеланиям дяди и немедленно. Траст не потребовал бы процесса утверждения. И что еще хорошо в трасте, так это то, что в таком случае не важно, находится ли бенефициар в США, или он иностранец – активы будут переданы ему в любом случае.

Почему я так много распространяюсь на эту тему? Если вы хотите оставить свои активы кому-то за границей, лучший способ обеспечить плавный процесс передачи – это пойти к уважаемому адвокату, создать траст и назначить родственников за границей бенефициарами этого траста. Таким образом, после вашей смерти, вашим родственникам не придется тратить понапрасну время и деньги на юридические издержки, и они получат все, что вы им хотите завещать, без каких-либо проблем.

Это случилось на самом деле. Однажды ко мне в офис пришла женщина лет 60-65. Ее супруг, с которым она прожила вместе 20 лет, внезапно скончался от сердечного приступа – по пути в банк, куда он нес чек с зарплатой. У нее и ее покойного мужа не было общих детей. Она работала медсестрой по уходу на дому, ее супруг был бизнесменом и был главным кормильцем семьи. У него были две дочери от первого брака: одна жила в России, вторая – в Канаде.

Обе дочери приехали на похороны отца и немедленно потребовали «свою долю» активов отца. Главным активом, оставшимся после его смерти, был дом, записанный на его имя. Этот дом был единственной крышей над головой супругов и главным источником и доходов: они сдавали первый этаж магазину, а второй – жильцу. Покойный не оставил после себя ни завещания, ни траста. Поэтому его активы (дом и все в нем) должны были распределяться согласно законам Нью-Йорка о наследстве. Обе дочери покойного от первого брака немедленно потребовали свои доли активов – в сумме чуть меньше половины дома.

Эта дама настаивала, что ее покойный муж никогда не планировал передавать дом в наследство дочерям, которые и так были состоятельны. Он никогда не планировал оставлять ее, свою жену на протяжении 20 лет, без гроша в кармане. К сожалению, это уже не имело никакого значения. Согласно законам Нью-Йорка, дочери могли претендовать на активы отца, поскольку ни он, ни его супруга не потрудились составить документ о создании траста. Эта женщина сообщила, что не могла себе и представить, чтобы ее муж внезапно упал замертво в возрасте 64 лет...

Как и следовало ожидать, дочери покойного, желая получить своё, потребовали, чтобы дом был продан по текущей рыночной цене (дом был оценен в $750,000, т.е. примерно $375,000 плюс часть внутренней обстановки причиталось им двоим). У вдовы не было денег на административные расходы (более $10,000 в конкретном случае) и, кроме того, не было жилья, где она могла бы поселиться после продажи дома. Беда одна не приходит: продав дом, женщина лишилась бы доходов со сдачи первого и второго этажей в аренду. Разумеется, она начала интересоваться, можно ли избежать продажи дома.

К сожалению, мне пришлось сообщить женщине, что на данном этапе что-то делать уже поздно – нужно выполнять требование дочерей покойного. Она не смогла бы «выкупить» долю дочерей и остаться в доме, поскольку ее зарплаты не хватило бы даже на оплату счетов. Женщина была крайне расстроена и настойчиво попросила меня, чтобы я поделилась ее печальной историей с другими.

Все мы стареем, и невозможно предсказать, что случится в следующий момент. Мы должны проявлять инициативу и планировать заранее: отправляйтесь к любому компетентному адвокату, чтобы составить простейший документ о планировании капитала (estate planning). Это особенно важно, если вы состоите во втором браке, у вас есть несовершеннолетние дети или старые родители, получающие SSI/Medicaid, но зависящие от вашей поддержки. Очень печально слышать реальные истории наподобие изложенной выше. И если после ее прочтения хотя бы один человек избежит повторения ошибок, совершенных мужем в этой истории, всем нам будет радостно оттого, что мы что-то изменили.

Second Marriage – What Happens When One Spouse Dies… (Based on True Story)

This is a true story. Woman in her sixties came to my law office. Her husband of twenty years died suddenly from a heart attack on the way to the bank to deposit his paycheck. She and her late husband had no children together. She works as a home attendant – her husband was a businessman and a main income producer. He had two daughters from prior marriage: one currently living in Russia, and another one in Canada.

Both daughters came to their father’s funeral and immediately demanded to get “their share” of father’s assets. The main asset, which was left, was the house, currently on late husbands’ name. The house was the spouses’ sole residence and the main source of income as they rented the first floor to the store, and the second floor to a tenant. The deceased husband left no will or a trust. Thus, his assets (house and all possessions inside it) would be distributed by default, in accordance with New York’s Intestacy laws. Two daughters from husband’s prior marriage immediately demanded their share of assets, which was slightly less than one-half of the house.

Woman stressed that her husband intended for her and not his daughters (who were both well off) to inherit the house. It was never his intention to leave her, his wife of over 20 years, penniless. Unfortunately, this was not the case. Under NY laws, his daughters were now entitled to receive their share of assets as neither her, nor her late husband ever bothered to write a trust. According to the woman, she never thought that her husband would suddenly collapse and die at the age of 64…

As expected, the late husband’s daughters, seeking their share, demanded that the house be immediately sold for its fair market value. (The house was evaluated to be $750,000. Consequently, approximately $375,000 plus assets inside the house belongs to two of them.) The woman had no money for the administration proceedings (in her case, over $10,000) and, moreover, had no place to live if the house had to be sold. To make her situation worse, upon losing the house, woman would also lose her “landlord income” from renting the first floor to the store and second floor to the tenant. Unsurprisingly, she was inquiring whether it was possible to avoid the sale of the house.

Unfortunately, I had to inform the woman that it was too late at this stage, other than to proceed with daughters demand. She would be unable to “buy out” her stepdaughters’ share and stay in the house, as her home attendant salary was not enough to even pay the bills. Woman was very distressed and explicitly asked me to share her story with others.

As we all age, it is impossible to predict what will happen at any given moment. We should be proactive and plan ahead: go to any competent attorney to draft basic estate planning documents. This is especially important if there is a second marriage, minor children or older parents who receive SSI/Medicaid, but depend on you for support. It is very sad to hear true stories such as this one. And if by reading it, at least one person will not make the same mistake as husband did in this story than we will all feel good about making a difference.

Каждый день мы слышим о все новых и новых докторах, арестованных за мошенничество с программами Medicaid и Medicare. Очень грустно и стыдно это слышать, особенно когда некоторые из этих докторов, как выясняется, практикуют в нашей т.н. «русской» общине. Некоторые из арестованных позднее становятся моими клиентами. Вместо того, чтобы ждать, когда очередной медик лишится своей лицензии из-за того, каким образом он вел свои дела, я решила написать эту статью - своего рода путеводитель, который позволит избежать мошенничества и злоупотребления программами Medicaid и Medicare.

Большинство докторов стремится в своей работе соблюдать профессиональную этику и выставляют оправданные счета. Общество возлагает огромное доверие на врачей, что правильно. Доверие – это основа отношений между доктором и пациентом. Когда наше здоровье наиболее уязвимо, мы полагаемся на то, что врач, используя свою высококлассную медицинскую подготовку, вернет нас на путь к скорейшему выздоровлению.

Однако федеральное правительство тожe возлагает огромное доверие на врачей. Medicaid, Medicare и другие федеральные здравоохранительные программы полагаются на разумность врача в определении, какое лечение необходимо получателю помощи от государства, и в выставлении обоснованного счета за это лечение. Вполне очевидно, что так бывает не всегда. Будучи адвокатом, я представляю множество докторов. В моей юридической практике я узнала одну интересную вещь о врачах: есть доктора (разумеется, не буду называть их имена), которые осознанно идут на мошенничество в своей работе и, вне сомнения, заслуживают наказания. Но есть и другие (большинство моих клиентов) – те, кто нарушает законы без злого умысла, просто не зная, что они что-то делают не так, и что некоторые процедуры при составлении счета не допускаются законом.

Mоя статья предназначена для второй группы – тех врачей, которые хотят практиковать в соответствии со всеми федеральными законами и законами штата, и кому необходима помощь в определении «красных флажков», заход за которые может привести к административной и уголовной ответственности.

Вот лишь несколько примеров неправильно выставленных счетов:

Психиатр был оштрафован на $400,000 и навсегда лишен права участвовать в федеральных здравоохранительных программах за то, что он указал в счетах проведение терапии, требующей очных сеансов с пациентом продолжительностью 30-60 минут, в то время как на самом деле он проводил 15-минутные приемы с применением медикаментов. Этот психиатр также указал, что он проводил эти сеансы, в то время как на самом деле их проводил человек без соответствующей лицензии.

Дерматолог был осужден на 2 года пробации и 6 месяцев домашнего ареста, а также был оштрафован на $2,9 миллиона после того, как он признал себя виновным в одном факте препятствия расследованию мошенничества в области здравоохранительных программ. Дерматолог сознался в подлоге результатов лабораторных анализов и подделке дат переписки с консультирующими коллегами с целью обосновать не соответствующие действительности диагнозы – таким образом, чтобы, согласно документации, пациенты страдали заболеваниями, покрываемыми программой Medicare, в то время как на самом деле этих заболеваний у них не было.

Кардиолог уплатил государству штраф в $435,000 и подписал с OIG 5-летнее «соглашение о добросовестности» (Integrity Agreement) в рамках сделки с правосудием – после того, как он был обвинен в умышленном выставлении счетов за консультации, которые не были занесены в историю болезни пациентов и вообще не могли быть классифицированы как консультация. Врач, согласно обвинению, умышленно выставлял счета за услуги по оценке и управлению (E&M), хотя ранее он уже получил плату за эти услуги по счетам, выставленным ранее за кардиоскопию с использованием радиоизотопов.

Эндокринолог учитывал обычные процедуры взятия крови как процедуры неотложной терапии. Он заплатил $447,000 штрафа за « upcoding» и другие нарушения правил выставления счетов.

Bсе медики очень упорно учатся, чтобы стать докторами. Они проходят через годы учебы в колледже, в медицинском ВУЗе и на больничной практике. Большинство из них покидают медицинский ВУЗ без цента в кармане и хотят побыстрее открыть свой собственный офис и начать делать деньги, чтобы компенсировать затраты на обучение и студенческий заем. Очень часто они по незнанию оказываются в описанных выше ситуациях и теряют заработанные упорным трудом лицензии или даже отправляются в тюрьму. Моя работа, как их адвоката – не допустить этого.

Инна, в Энциклопедии Русской Америки обычно рассказывают о себе. У Вас есть 15 минут. Начнем с места рождения, даты, если Вы хотите.

Родилась я в 1973-м году, в городе Харькове. 1973-й год вошел в историю, как год арабского oil-эмбарго, и события моей биографии связаны с событиями еврейского мира. Потому что фамилия моя – Ферштейн. С такой фамилией в городе Харькове жить было тяжело, особенно еврейскому ребенку. Поэтому записали меня, как Инну Ферштейн, а для поступления в муз-десятилетку, в школу для одаренных детей, пришлось паспорт потерять. Дедушка мой работал в оперном театре, он шил балетки, был сапожником, и замечательные его балетки были на выставке. А по настоящему, конечно, он шил обувь - такая еврейская профессия. Пошил он обувь директору муз-десятилетки, и меня взяли в школу без паспорта. Таким образом, я закончила 10 классов.

И без фамилии?

Фамилию записали другую, не еврейскую, потому что еврейских детей в муз-десятилетку не брали.

Такой вот город Харьков?

Синагоги в городе Харькове не было, и папа мой, с фамилией Ферштейн, не смог учиться в Радиотехническом институте, потому что с евреями там обращались не очень хорошо. О том, что я еврейка, я узнала, будем говорить, только тогда, когда мы уезжали, потому что мне об этом не говорили. Еврейские праздники мы боялись отмечать, хотя прадед мой ходил в синагогу, а прабабушка моя родилась за чертой оседлости. У нас есть свидетельство о ее рождении, подписанное раввином Бердичева. Фамилия – Бердичевская.

Так вот, занималась я в муз-десятилетке, в замечательной школе, которая дала мне профессию концертной пианистки. И, по приезде в Америку, мне эта профессия очень помогла. Не говоря ни слова по-английски, я смогла поступить в нью-йоркский Университет и получить scholarship. Для того, чтобы я играла на пианино, мне разрешили, как бы, дальше учиться.

А что, в этом нью-йоркском Университете Вы аккомпанировали кому-то?

Нет, я просто играла на пианино. Я не собиралась этим заниматься здесь, но, кое-что хорошее мне город Харьков дал.

А в каком году Вы иммигрировали?
В 1991-м году мы приехали – самое начало перестройки.

То есть, Вы окончили школу в Харькове?

Я закончила муз-десятилетку в Харькове. Родители мои сделали очень большое дело, привезли детей сюда, дали нам возможность здесь стать на ноги и стать здесь тем, кем мы стали.

У Вас еще сестры, братья…?

Мой брат родился в 1979-м году, и его рождение совпало с войной в Йом-Кипур. Многие люди иммигрировали в Израиль. Тогда было достаточно тяжело уехать, хотя родители об этом мечтали в то время, потому что большинство наших знакомых были диссиденты. Большинство наших знакомых сидели за ту литературу, которую они читали. Ну вот, в 1991-м году, как только границы открылись еще раз, моя семья быстренько собралась и уехала сюда. И что самое интересное, приехали мы, бросили все, потому что тогда, когда мы уезжали, нам, как бы, ничего не принадлежало.

Приехали мы сюда: нас было 6 человек, у нас было по чемодану на человека или, по-моему, два чемодана разрешалось, я не помню, тогда. Помню, как мы паковали это все, и мама паковала в разные чемоданы – разные вещи, потому что если один чемодан потеряется, чтобы не потерялись все твои вещи сразу. Баулы шили – это была, как бы, занимательная черта каждого эмигранта. И давалось, по-моему, $100 на человека. Вот, $600 у нас было на 6 человек, эти 2 чемодана на человека – это все, с чем мы сюда приехали, после такой замечательной жизни в городе Харькове.

Прямой был рейс? Харьков – Нью-Йорк?

Нет, мы летели так... Помните, тогда в 1991-м году, сначала мы летели в Австрию, в Австрии мы меняли наши «вызовы» на Италию, и через Италию, через Ладисполи, мы приехали сюда. Через 4 месяца мы приехали уже сюда.

Обычный путь эмигранта. Вы в Ладисполи жили в 1991-м году?
Мы жили в 1991-м году в Ладисполи, еще был открыт Ладисполи. И самое интересное, что Александр Грант, с которым мы только что вели телепередачу на RTN, тогда еще брал интервью у моего папы. Тогда мировоззрение, конечно, было… Мы приезжаем туда, у нас открыты глаза, и мы только сейчас видим мир, мы видим эти улицы, которые шампунем моют в Австрии, мы видим людей, мы видим магазины, мы видим, вообще, что есть жизнь, и человеку можно жить. И самое главное, что мы приходим к реализации того, что мы евреи, и что это значит.

Вы, когда сюда приехали, сразу в синагогу пошли?

Приехали мы сюда благодаря HIAS и благодаря NYANA, и благодаря организациям, которые нас сюда привезли. Моя мама сразу пошла в Ешиву, учителем математики, и она продолжает работать там. Она «учитель года» с тридцатилетним стажем. Мой брат пошел работать в Боро-парк, он стал стокброкером, закончил колледж, Университет, и достаточно успешный стокброкер. Я, закончив нью-йоркский Университет в числе 5% лучших учеников, опять-таки на scholarship, потом еще пошла в юридическую школу Benjamin Cardozo. Окончила эту школу и стала работать и заниматься общественной деятельностью.

Какой Вы факультет закончили в NYU?

В NYU я закончила очень интересный факультет: Music, Business and Technology. Я играла, делала piano performances, я занималась music business.

То есть, изучали правила музыкальной индустрии?

Правила музыкальной индустрии. Я могла быть менеджером, я работала в интересных фирмах. Я могла быть продюсером, но решила учиться дальше, потому что мне хотелось все-таки получить возможность изъясняться здесь лучше на английском языке и получить возможность знать законы и делать что-то другое. С большим удовольствием. Я очень любила эту школу; это - еврейская школа, еврейский университет: школа Бенжамина Кардозо принадлежит Yeshiva University. Там я, в числе 10% лучших учеников, окончила эту школу. Надо сказать, что все ребята, которые приехали вместе со мной в 1991-м году, и, может быть, позже, закончив нью-йоркский университет достаточно тяжело работали. И сейчас все мои знакомые – это люди, достаточно хорошо стоящие на ногах. Они достигли в американском обществе довольно больших вершин.

Вы имеете ввиду тех, кто в 1991-м году сюда прибыли, или все Ваше поколение?

Мое поколение, те, кто вместе со мной занимался в NYU. Мы просто приехали совсем ни с чем. Мы понимали, что мы только дорогу можем пробить сами себе. Мы получились, как Sandwich generation, то есть, мы должны были помогать родителям, которые превратились в детей, попав в другую среду, потеряв язык, потеряв профессию. И мы должны были учиться дальше и пробиваться здесь сами.

Но Вы приехали в замечательном возрасте, как раз в студенческое время.

Я приехала в замечательном возрасте, но мы не чурались никакой работы. Я работала и на $3 в час в магазине, и занималась в NYU.

В продуктовом магазине?

Нет, мы продавали вещи. Потом с этого чека еще снимался налог – tax. Работала в NYU, работала на двух других работах, заканчивала колледж. И, как бы, это было нормально, друзья делали то же самое. И теперь они: top traders на Wall street, профессора, адвокаты, врачи. Приятно видеть, когда люди здесь достигли чего-то. Самое главное, что я бы хотела донести до своих детей, до того поколения, которое, может быть, будет это смотреть: нам было достаточно тяжело, но те основы, на которых мы выросли, книги, на которых мы выросли, нам очень много дали. Мы выучили, что такое дружба, мы выучили, что такое помогать кому-то, что такое конкуренция – competition. Здесь, конечно, в Америке все это объединилось с возможностью достичь чего-то, с возможностью трудиться, с возможностью работать. Поэтому мы достигли каких-то вершин, мы достигли каких-то высот. Мне бы очень хотелось, чтобы мои дети сделали то же самое, чтобы они не начали с какого-то другого рубежа, чтобы они работали очень тяжело и тоже чего-то достигли.

И неотъемлемая часть человека, который чего-то достиг, это возможность – дать обратно, это желание дать обратно. Мы приехали сюда совершенно ни с чем, мы приехали сюда с двумя чемоданами, мы приехали благодаря еврейским организациям, на деньги которых мы попали в эту страну. Поэтому часть того, чем я начала заниматься сейчас – это общественная деятельность, это желание и возможность дать обратно.

Вернуть, как бы, долг?

Вернуть долг и дать возможность моим детям войти в это общество полноценно, войти в это общество, как члены этого общества, заниматься какими-то вещами, которые интересны для меня. Меня очень интересует еврейская жизнь, жизнь еврейского народа, культура еврейского народа и жизнь наших соотечественников, которые здесь… Опять-таки, уже прошло лет двадцать, как мы приехали. Мы - из берущих (тех людей, которые берут и приехали на помощь благотворительных организаций) в одном поколении, превратились в дающих, в тех, кто может дать обратно. Необходимо понять то, на сколько важно давать, и не только давать свои деньги, но и свое время, и свое внимание возвращать этому обществу. Без этого мы никто, без этого мы единицы, которые каждый сам по себе, каждый сам за себя.

Я стала членом Совета директоров Еврейского центра Бенсонхерста. Я помогла открыть еврейскую школу для еврейских детей, которая, соответственно, не касается моих детей, но она касается еврейского народа. Эта школа называется Menachem Education Foundation. Для учителей, для того, чтобы они лучше учили еврейских детей, которые занимаются в Ешиве. Потому, что в Ешиве учителя получают копейки, учителя не хотят на это идти, и очень многие люди, закончив Ешиву, не получают должного образования.

Так вот, я даю деньги на то, чтобы существовала эта Education Foundation, чтобы они учили учителей, как быть лучшими учителями. Я помогла детскому музыкальному театру. В нашей школе, здесь, есть замечательная учительница из бывшего Советского Союза, которая делает потрясающие спектакли, которая делает потрясающие шоу для русскоговорящих детей. Я помогла ей открыть и вести этот театр, детский музыкальный театр, для того, чтобы дети не забывали русский язык.

А сколько у Вас детей, кстати?
У меня трое детей.

По возрасту можно их перечислить?

Все трое моих детей занимаются в gift and talented program NYC - в общеобразовательной школе для одаренных детей. И они все пишут и читают по-русски. Это часть этой программы. Непосредственная часть того, в чем я участвовала – для русскоязычных детей - я помогала открыть эту программу, когда она была закрыта городом. Опять-таки, потому что очень важно, чтобы дети знали свои истоки, свои корни, чтобы дети говорили на языке. Чтобы они понимали, что они евреи, но что они русскоязычные евреи, что родители приехали из той страны. Ну, Вы теперь адвокат, человек, который поддерживает и школы, и различные программы, и.т.д. Но я вспомню: 10 лет – все-таки это музыкальная школа. И вот, тяга к тому, чтобы заниматься искусством, что-то посещать, она осталась? Личная жизнь какая-то, кроме всего этого, есть?

Конечно, мы живем в замечательном городе – в Нью-Йорке. В этом городе, по-моему, есть все и для всех. Конечно, мы обязательно ходим в Метрополитен Опера. Мой сын очень любит Нетребко, он пересмотрел многие оперы с ее участием. Мы занимаемся с моей младшей дочкой музыкой, она замечательно поет. Мы обязательно посещаем и филармонические концерты, и обязательно читаем книги, и участвуем в жизни Нью-Йорка. Это очень важно. У меня дома, конечно, есть пианино, я играю с детьми и стараюсь совмещать культурное, приятное с полезным.

А кто же муж? Он Вас поддерживает?

Мой муж – программист. Он - обязательно… Правая рука не может работать без левой, все может быть только в одной семье. Это очень важно и для детей, и для тебя самого. У мужа моего было немножко другое детство, потому что он вырос в Одессе, его покойная бабушка была в гетто. Совершенно другое у него восприятие всего этого, потому что Одесса, все-таки, была другим городом, там можно было быть евреем. Но, при этом, для нас главное – это наши родители, наши предки, наше комьюнити, наши дети, наша семья и будущее наших детей, образование наших детей, прежде всего.

Как избежать мошенничества и злоупотребления программами Medicaid и Medicare

Однако и федеральное правительство возлагает огромное доверие на врачей. Medicaid, Medicare и другие федеральные здравоохранительные программы полагаются на разумность врача в определении, какое лечение необходимо получателю помощи от государства, и в выставлении обоснованного счета за это лечение. Вполне очевидно, что так бывает не всегда. Будучи адвокатом, я представляю множество докторов. В моей юридической практике я узнала одну интересную вещь о врачах: есть доктора (разумеется, не буду называть их имена), которые осознанно идут на мошенничество в своей работе и, вне сомнения, заслуживают наказания. Но есть и другие (большинство моих клиентов) – те, кто нарушает законы без злого умысла, просто не зная, что они что-то делают не так, и что некоторые процедуры при составлении счета не допускаются законом.

Таким образом, моя статья предназначена для второй группы – тех врачей, которые хотят практиковать в соответствии со всеми федеральными законами и законами штата, и кому необходима помощь в определении «красных флажков», заход за которые может привести к административной и уголовной ответственности.

Разделение платы (Fee Sharing) – Доктор не имеет права заниматься бизнесом совместно с партнером без медицинской лицензии. Поэтому получаемая доктором плата не может быть разделена с партнером без медицинской лицензии, даже если этот человек вложил свои деньги в медицинское заведение, в котором работает этот доктор. За свою адвокатскую практику я повидала немало Соглашений об управлении и субаренде и прошлась по каждой их строчке вместе с моими клиентами-докторами. Но лишь совсем недавно я встретила доктора, который заявил мне, что «30%» от его счетов выставляла управляющая его делами компания, и что никаких проблем в этом он не видел. Это чудо, что я встретила этого доктора раньше, чем инспектор из Office of Medicaid Inspector General did…

Мошенничество со счетами (Fraudulent Billing): выставление счетов – ахиллесова пята каждого врача. Еще одна распространенная проблема при выставлении счета – это предоставление услуг, которые не были «обоснованы с медицинской точки зрения».

Вот лишь несколько примеров неправильно выставленных счетов:

В заключение, я бы хотела добавить, что все медики очень упорно учатся, чтобы стать докторами. Они проходят через годы учебы в колледже, в медицинском ВУЗе и на больничной практике. Большинство из них покидают медицинский ВУЗ без цента в кармане и хотят побыстрее открыть свой собственный офис и начать делать деньги, чтобы компенсировать затраты на обучение и студенческий заем. Очень часто они по незнанию оказываются в описанных выше ситуациях и теряют заработанные упорным трудом лицензии или даже отправляются в тюрьму. Моя работа, как их адвоката в области здравоохранения – не допустить этого.

Avoiding Medicaid and Medicare Fraud and Abuse

Guide for every Physician:

Every day we hear about new doctors being arrested for Medicaid and Medicare Fraud. It’s sad and shameful to hear, especially when some of those doctors are practicing in our so-called “Russian” community. Some of the doctors arrested later become my clients. Instead of waiting for another physician to lose his license because of the way he runs his practice, I decided to write this article as a “Road Map” on how to avoid Medicaid and Medicare Fraud and abuse.

Most doctors strive to work ethically and submit proper claims for payment. Society places enormous trust in physicians, and rightly so. Trust is at the core of the physician-patient relationship. When our health is at its most vulnerable, we rely on physicians to use their expert medical training to put us on the road to a healthy recovery.

The Federal Government, however also places enormous trust in physicians. Medicare, Medicaid, and other Federal health care programs rely on physicians’ medical judgment to treat beneficiaries with appropriate services and to bill for such services correctly. This obviously is not always the case. I represent a lot of doctors in my practice as an attorney. In my legal practice I find one thing interesting about doctors: there are some doctors (I will obviously never name them) who deliberately run their practices in violation of the laws and clearly deserve to be punished. There are others (who comprise most of my clients), who violate the laws unintentionally – simply by not knowing that they were doing something wrong and that certain billing practices are illegal.

Thus, my article is intended for the second group - those physicians who want to run their practice in compliance with every State and Federal regulation and who need my help to identify “red flags” that could lead to potential liability in law enforcement and administrative actions.

The five most important Federal fraud and abuse laws that apply to physicians are the False Claims Act (FCA), the Anti-Kickback Statute (AKS), the Physician Self-Referral Law (Stark law), and the Civil Monetary Penalties Law (CMPL). Government agencies, including the Department of Justice, the Department of Health & Human Services Office of Inspector General (OIG), and the Centers for Medicare & Medicaid Services (CMS), are charged with enforcing these laws.

Under the False Claims Act: It is illegal to submit claims for payment to Medicare or Medicaid that you know or should know are false or fraudulent. Filing false claims may result in fines of up to three times the programs’ loss plus $11,000 per claim filed. Criminal penalties for submitting false claims include imprisonment and criminal fines. Physicians have gone to prison for submitting false health care claims.

Anti-Kickback Statute (AKS) is a criminal law that prohibits payment of “remuneration” to patient referrals or the generation of business. Remuneration includes anything of value and can take many forms besides cash, such as free rent, expensive hotel stays and meals, and excessive compensation for medical directorships or consultancies. In some industries, it is acceptable to reward those who refer business to you. However, in the Federal health care programs, paying for referrals is a crime.

Fee Sharing – It is illegal for a doctor to be in business with non-doctor. Thus, any fees charged by a doctor cannot be split with non-doctor, even if this non-doctor invested into the medical facility such doctor occupies. Yes, as attorney I have seen a number of Management and Sublease Agreements and I went over every line in this agreement with my doctor clients. However, just recently I met a doctor who told me she was getting “30%” of billing done by a management company and she saw nothing wrong with this arrangement. It’s a miracle that I met this doctor before Office of Medicaid Inspector General did…

Fraudulent Billing – Billing is Ahyles foot of every physician. I tell all my physician clients: When you submit a claim for services performed for a Medicare or Medicaid beneficiary, you are filing a bill with the Federal Government and certifying that you have earned the payment requested and complied with the billing requirements. If you knew or should have known that the submitted claim was false, then the attempt to collect unearned money constitutes a violation.

A common type of false claim is “upcoding,” - using incorrect billing codes for more severe illness than actually existed or a more expensive treatment than was provided. Another common problem with billing – billing for services that were “not medically necessary”.

Here are just some of the examples of incorrect billing:

• A psychiatrist was fined $400,000 and permanently excluded from participating in the Federal health care programs for misrepresenting that he provided therapy sessions requiring 30 or 60 minutes of face-to-face time with the patient, when he had provided only medication checks for 15 minutes or less. The psychiatrist also misrepresented that he provided therapy sessions when in fact a non-licensed individual conducted the sessions.

• A dermatologist was sentenced to 2 years of probation and 6 months of home confinement and ordered to pay $2.9 million after he pled guilty to one count of obstruction of a criminal health care fraud investigation. The dermatologist admitted to falsifying lab tests and backdating letters to referring physicians to substantiate false diagnoses to make the documentation appear that his patients had Medicare-covered conditions when they did not.

• A cardiologist paid the Government $435,000 and entered into a 5-year Integrity Agreement with OIG to settle allegations that he knowingly submitted claims for consultation services that were not supported by patient medical records and did not meet the criteria for a consultation. The physician also allegedly knowingly submitted false claims for E&M services when he had already received payment for such services in connection with previous claims for nuclear stress testing.

• An endocrinologist billed routine blood draws as critical care blood draws. He paid $447,000 to settle allegations of upcoding and other billing violations.

In conclusion I want to add that all physicians studies extremely hard to become doctors – they went through years in college, medical school, residency training. Most physicians come peningles from Medical School and are eager to open their own offices and start making money to recoup the costs and to pay off their college loans. Very often, unknowingly they get themselves into schemes outlined above and end up losing their hard earned medical licenses and even going to jail. My job as their health care law attorney is to prevent this from happening

Что такое траст?

Траст – это Контракт. Если вы желаете соблюсти конфиденциальность своих личных дел, то Траст - любой Траст - позволит избежать процесса утверждения завещания; отзывной или безотзывной Траст, а также Траст, инициированный как учредителем, так и иным лицом (grantor/non-grantor), позволят избежать процесса утверждения наследства. Траст – это не только для богатых. Любой человек с состоянием $100,000 и более должен иметь Траст.

Какой тип траста лучше всего подходит для моих нужд?

Идеальный Траст для состояний менее $500,000 – это Доверительный Траст (Living Trust), или Отзывной траст (Revocable Trust), который позволит избежать процесса утверждения завещания. Каждый человек с более существенным состоянием должен иметь Безотзывной Траст (Irrevocable Trust). Отзывной Траст: В случае Отзывного Траста слово «отзывной» означает, что у вас остается достаточно полномочий, позволяющих отозвать контракт, аннулировать и расторгнуть его. И хотя это позволит избежать процесса утверждения завещания и перебирания вашего грязного белья на публике, такой траст не позволит избежать налогов на наследство, поскольку в день смерти вы все равно были владельцем ваших активов.

С точки зрения налогообложения и ответственности перед истцами, наличие слова «отзывной» означает, что вы не отказались от контроля над вашими активами и «владеете» ими на долговременной основе; таким способом, вы «признаетесь» владельцем активом. Налог на Наследство рассчитывается на основании того, какие активы записаны на ваше имя по состоянию на день вашей смерти. Таким образом, утверждение завещания – это процесс определения, кто получит что; расчет Налога на наследство – это процесс определения, кто владеет чем и сколько налогов с этого причитается.

Безотзывный Траст: Безотзывный Траст – это Контракт, которым вы отказываетесь от каких-либо «претензий на владение» вашими активами, переводимыми/передаваемыми вами вашему Безотзывному Трасту. Ключевой момент отказа от претензий на владение – это Независимый Попечитель.

Ваш «Попечитель» должен быть «независимым». Вы не можете быть Попечителем; Попечителем также не может быть Бенефициар. (Если вы являетесь Дарителем подобного траста, ваша супруга может быть Попечителем, а сын/дочь - Бенефициаром. Однако, ваша супруга не может быть Попечителем и Бенефициаром в Безотзывном трасте).

Как уже говорилось, неважно, насколько хорошо было составлено завещание – оно все равно должно отправиться в Суд по наследству, где оно становится публичным документом, который доступен всем заинтересованным сторонам. Единственный способ избежать процесса утверждения завещания – это переписать все свое имущество и ценные активы на Траст.

With much discomfort I have been forced to watch the Anna Nicole Smith probate proceedings and much more information than I wanted to know about Anna Nicole's life events. Her reported death was everywhere: on TV, in print, magazines, online and everywhere else you can imagine. The media has made a circus of showing the legal battle going on in open court about the six-year-old will and interpretation thereof.

Can it ever happen to you?

Yes, if you only leave a will. A will does not avoid probate. A will does not eliminate the estate tax. If you die with a will or without a will your personal and real property has to go to probate. If you have property in more than one state, each states' probate court has jurisdiction to probate the will.

What's a probate? Why does a Will need to go through Probate?

Probate is a public process whereby a local court of jurisdiction (probate court) assumes the responsibility of determining who gets what. The court will determine the legitimacy of your will? Was it written with undue influence? Is it the last will? Who is the true executor (i.e. the person who will make the distributions under court jurisdiction)? Did it assign custody for minor children?
The probate court will take inventory of your personal and real property. In addition, the probate court will assign and investigate claims made against your property from potential and real creditors and even assign accountants and lawyers to drag the process.

So why have a will at all? What good does it do?

There are two legitimate reasons for having a will. The will enables:

(1) The assignment of a custodial guardian of minor children.
(2) The assignment of an executor.

The assignment of choosing a guardian for your minor children is the most important aspect of having a will. Choose your custodian well, based on the love of your children as if you were going to be there. Traditionally, you would not choose the executor of your will to be the guardian of your minor children.

There's a balance to be had between the Executor and the Guardian of your children. The Executor would have some degree of control if there were to be any uncontemplated issues, later in time. All other aspects of the will can be highly contested by anyone having an interest in the outcome of any distributions. Even a very well drafted will becomes a public document and must go to probate in each state where the decedent had property.

What can one do to avoid the type of circus Anna Nicole Smith had over YOUR assets?

Aside from the custody of minor children, a will does not provide any type of safety net over your assets. Only a Trust will avoid this public disclosure of what should be a private matter between you and your assets you leave behind. So a simple answer to this question – get a consultation with qualified Estate Planning attorney and create a trust!

What is a Trust?

A Trust is a Contract. If you choose to be private about your private matter, a Trust, any Trust, will avoid probate; revocable or irrevocable, grantor or non-grantor type Trusts will avoid the probate process. A Trust is not just for the rich. Any one with $100,000 or more should have a Trust.
What type of trust is best suited for my needs?
A perfect Trust for under $500,000 is a Living Trust, or a Revocable Trust to avoid the probate process. Any one with significant assets should have an Irrevocable Trust. While any Trust will avoid the probate process, only an Irrevocable Trust will avoid the probate process and also avoid the inheritance tax or the estate tax.

What’s the difference between Revocable and Irrevocable Trust?

Revocable Trust: With a Revocable Trust the word "revocable" means that you have sufficient strings to revoke the contract; nullify and void it. While it will avoid going to probate and drag your dirty linen through the public process, it will not avoid the inheritance/estate tax, because on the date of your death you still owned your assets in your name.

For purposes of taxation and civil liability the "revocable" strings attached, means that you did not give up power to control and "own" on a long-term basis your assets; therefore, you are the "deemed" owner of the assets. The Estate Tax is based on what you own in your name at the date of your death. So, the Probate Process is about who gets what; the Estate Tax is about who owns what and what's it worth for the purpose of taxation.

An Irrevocable Trust: An Irrevocable Trust is a Contract whereby you give up "any ownership claims" against your assets repositioned/transferred from you to your Irrevocable Trust. The key to dissolve your ownership claims is with an Independent Trustee.

Your "Trustee" must be "independent." The Trustee cannot be you and it can not be the Beneficiary. (If you are the Grantor of such trust, your wife can be the Trustee and your son/daughter can be the Beneficiary. However, your wife can not be a Trustee and a Beneficiary in the Irrevocable trust).

As mentioned before, no matter how well drafted, a will must go to probate where it becomes a public document for every interested party to view and review. The only method of avoiding the probate process is to have your possessions and valuable assets titled to a Trust.

Though the tragedy of Anna Nicole Smith and her baby daughter's plight cannot now be avoided, we can learn from this situation and apply remedial steps to our own life. Here are some things for you to consider in your life:

• All Trusts, revocable or irrevocable, grantor or non- grantor avoid Probate.
• A will does NOT avoid Probate.
• A will does NOT avoid Estate Taxes.
• Only an "Irrevocable Trust" avoids Estate/Inheritance Taxes.

Sen. Nicholas J. Sacco of New Jersey proposed a law that would deem it a Criminal offence to not reprot a child missing within 24 hours of discovery. This is in response to they Casey Anthony trial where Casey Anthony was found not guilty of murdering her child and ordered to serve about as much time as she already had for lying to police and the court. Had the law been in place at the time of the trial, Casey Anthony would have gotten as much as 3 more years in jail and up to $40,000 in fines.

Casey Anthony verdict

On June 16 2008, Caylee Anthony was reported missing. She was reported to be with her mother Casey Anthony. Sadly, on December 11th of the same year, she was found dead. Her killer is thought to have been her mother and the verdict was announced today.

Casey Anthony was found not guilty on the charge of murder and aggravated manslaughter. The only counts she was found guilty on were misdemeanors which would give her up to 4 years in jail, 2 and a half of which she had already served. The misdemeanors were the different lies and fabrications she had come up with to explain the disappearance of the child, including wrongfully implicating one Zenaida Fernandez-Gonzalez in the murder.

The American jury found her not guilty for reasonable doubt and circumstantial evidence. Forensic analysis on the body was impossible because of the long period of decay and DNA evidence tying the car as a possible storage point for the body was not proven.

Should the courts have found her guilty of murder based on the perjury and circumstantial evidence?

A: Yes. Many people do simple wills before their death and do not seek advice of professional Estate Planning attorney. As a result, they forget about such important assets in their estate as IRAs, 401K(s) and other retirement accounts.

Independent of your intentions, such as seeing the assets distributed to your wife and children, custodians of retirement accounts must follow the directions of the beneficiary designation form - even if that means that $2 million of the assets legally go to an ex-wife from 20 years ago.

Q: What should I do to make sure correct beneficiaries inherit all of my estate?

A: Consult with an Estate planning attorney prior to divorce, marriage, birth of a child and other important life changing event. Many divorce attorneys do not draft separation or divorce documents properly often forgetting about very important assets that by law belong to your current spouse. Such assets are your IRAs, 401(k)s, pension plan accounts and others. If you designate someone other than your spouse to inherit such assets, you need your spouse's permission! If you get divorced from that spouse, you must properly remove such spouse from those assets.

Most important advice any good attorney can give you - review your estate plan including your beneficiary designations annually and during important changes in your life. And for once, let the professional handle your estate planning needs!

An Inheritance Shocker - Retirement Account Beneficiaries

Do you want your spouse to inherit the money in your 401(k) — or do you want your former spouse to get it? If you are divorced, remarried or have children from a previous relationship, make sure you have updated the beneficiary designation for your retirement plan at work. Otherwise, your spouse or kids could be in for a shock.

A shock is exactly what William Kennedy gave his daughter, Kari. The elder Kennedy married Kari’s mom in 1974 while working for DuPont. He named his wife as the beneficiary of his 401(k), and with no children at the time, he left blank the contingent beneficiary (who would get the money if the wife died first).

When the couple divorced in 1994, his ex-wife agreed to relinquish any rights to the money in the plan so that Kari would receive the money. But William did not sign new papers at work to officially change his beneficiary designation. So when he died in 2001, DuPont gave his ex-wife the proceeds — $400,000.

Kari sued DuPont, arguing that it violated the divorce decree by giving the money to her mother. The case made it all the way to the Supreme Court, which recently ruled in favor of DuPont. The majority ruled that DuPont acted in accordance with ERISA, the law governing retirement plans, which stipulates that beneficiary designations trump all other agreements.

The lesson: It’s not enough to sign a contract or write a will. If you want someone to be the heir of your retirement plan at work, you must stipulate your instructions in the trust documents. Have you done your Estate Planning lately? Have you reviewed your beneficiary designations lately to make sure that the people you want to get your money are really the people who will get your money? If you haven’t done so recently, go to your attorney and do your Estate Planning properly.

Footnote: The court noted that Kari could sue her mother based on the divorce agreement, but that won’t do her any good. She told her hometown newspaper The Enterprise that her mother died in 2007 after moving to Norway and spending all the money.

Gifted and Talented Programs in NYC 2010 - Increase in High-Scoring Students

The number of students qualifying for gifted kindergarten programs in New York City public school districts rose by 10 percent this year, and those qualifying for the elite citywide program jumped by a third, raising the possibility that parents and their children have begun to master an admission process that was retooled three years ago.

According to figures released Friday by the Department of Education, the spike in students eligible for gifted programs occurred despite a 16 percent drop in the number who took the exams. The city described the decrease as a “leveling off” after an increase in test-takers last year, which they attributed to a publicity campaign.

Of the 12,454 in New York City who took the test this winter, 3,542 (or 26 percent) scored at or above the national 90th percentile, up from 3,231 the year before, qualifying them for one of the 70 gifted kindergarten programs spread through the city’s school districts. But the most striking increase occurred in the number of children scoring at or above the national 97th percentile: 1,788, up from 1,345 last year. Those students qualify for one of the five citywide gifted programs, which have only about 300 seats in all, meaning the competition for them this year will be even fiercer.

Already, the bar for admission to at least one of the citywide programs, the Anderson School on the Upper West Side, has been raised to the 99th percentile for most of its 50 seats. Almost 300 parents whose children scored that high attended recent daytime tours.

Anna Lewiston of the Upper East Side was determined to send her daughter, Lena, to Anderson but was told that the girl’s 97th-percentile score would not make the cut. Lena will go to a private school. “It’s really too much pressure for preschoolers,” Ms. Lewiston said of the test.

Another citywide program, the Brooklyn School of Inquiry in Gravesend, allowed 540 parents on tours before turning others away. The principal, Donna Taylor, said she noticed growing anxiety among them when they saw the odds of getting one of her 56 slots.

“It’s heartbreaking,” she said. Children who are not selected for citywide programs are eligible for district-based gifted programs; students may also enroll in regular kindergarten classes at their neighborhood schools.

The cause of the higher passing rates was not clear, but increased preparation might have been a factor. Hundreds of parents hired tutors or bought commercial test preparation materials before taking this year’s test, a mixture of the Otis-Lennon School Ability Test, a reasoning exam, and the Bracken School Readiness Assessment.

At the Perry School, a preschool in the West Village, children spent an hour a day in a “think tank program” designed to expose them to the reasoning and materials they would see during the test. They also had professional tutoring. Of the five students who took the gifted exam, “we got two 99s, a 98, and two 97s,” said Dawn Ifrah, the founder.

Bright Kids NYC, the tutoring company that worked with those children, reported that 80 percent of the 120 children for whom it had results had scored over the 90th percentile, and 60 children had scored in the 99th.

Department of Education officials acknowledged that preparation may have played a role but said they were confident that most children who passed belonged in accelerated classes. They added that the city was trying to increase the number of full-day preschools in poor, black and Hispanic neighborhoods, which are underrepresented in the gifted programs.

Anna Commitante, who heads the gifted and talented program, said the city “may very well think about something different” after next year, when its contract with testing companies expires. But officials later said no policy change was under consideration.

Susan K. Johnsen, the president of the Association for the Gifted, a division of the Council for Exceptional Children, recommends the use of many measures to assess giftedness, like observation, recommendations and student work, not simply tests. “Any test is susceptible to test preparation, and that’s why you start to invalidate those assessments,” Dr. Johnsen said.

The increase in high-scoring students was concentrated in the middle- and upper-middle-class districts of Manhattan and Queens. In the Bronx, fewer students qualified this year.

In District 3, which includes the Upper West Side, 455 children, a full 47 percent of those who took the test, scored at or over the 90th percentile, and 250 scored at or over the 97th, compared with 218 last year. In Manhattan’s District 2, 44 percent of the test-takers qualified, and 341 pupils got top scores, a 42 percent increase.

In the past, the city’s 32 school districts used diverse criteria for gifted admission, but the city made the test the sole factor in 2008, in part to address allegations of favoritism and the overrepresentation of white children in the programs. Yet nearly 70 percent of students in the programs are white or Asian, the reverse of the racial composition of the school system as a whole.

How the New Wealth Taxes Will Hit You

We will soon be paying a lot more taxes. According to the new health-care bill that Congress passed in March, new taxes will have to be paid: an extra .9% tax on wages for couples earning more than $250,000 ($200,000 for singles) and a new 3.8% tax on investment income.

What it means for us, ordinary people is that our earnings will be taxes more. For workers, the extra 0.9% levy puts a progressive element in what used to be a totally flat tax. The 3.8% tax on investment income also knocks down a longstanding wall by applying a "payroll" tax to unearned income. Until now, FICA taxes for Social Security and Medicare have applied only to wages, not investment income.

While many details remain unclear and the Internal Revenue Service hasn't issued any guidance, here are preliminary answers to the most important questions taxpayers are asking.

These taxes take effect in 2013, two elections away. Might they be repealed first?

Not likely. "Congress would have to undo the health reform, and budget constraints would still be there," says Clint Stretch of Deloitte Tax. "Even if Republicans take control of Congress, President Obama holds the veto pen until Jan. 20, 2013."

How does the 0.9% tax work?

If Mark and Victoria each earn $175,000, their total employment income is $350,000. Currently they owe 1.45%—$5,075—of regular Medicare tax, and their employers owe a matching amount. In 2013, the couple will owe an extra 0.9%—$900—on their wages above $250,000, which is $100,000. Their employers pay nothing extra.

What about the 3.8% tax on net investment income?

This levy is keyed to "modified adjusted gross income," with a threshold of $250,000 for couples and $200,000 for singles. (This is simply adjusted gross income for nearly everybody except expatriates, who must add back certain exclusions.) The tax is a flat 3.8% on investment income above the threshold.

How would this work?

Example 1: Mark and Victoria, a married couple, have $400,000 of AGI—$200,000 of wages plus $200,000 of investment income. Because they have $150,000 of investment income above the $250,000 threshold, they would owe an extra $5,700.

Example 2: Anne, a single filer, earns $40,000 but has an investment windfall of $190,000, for total income of $230,000. Because she has investment income of $30,000 above her $200,000 threshold, she would owe $1,140 of additional tax.

Example 3: Retirees Mary and Bill have no wages but they do have a taxable IRA payout of $90,000, plus investment income of $150,000, for a total of $240,000. They don't owe the new tax, because they have no investment income above the $250,000 threshold.

What is investment income?

Interest, except municipal-bond interest; dividends; rents; royalties; and capital gains on the sales of financial instruments like stocks and bonds. The taxable portion of insurance annuity payouts also counts, unless it is from a company pension. So do gains from financial trading, as well as passive income from rents and businesses you don't participate in. All are subject to the 3.8% tax on amounts above the $250,000 or $200,000 threshold, as described above.

Not taxed: Distributions from regular and Roth IRAs and other retirement accounts, including pensions and Social Security, and annuities that are part of a retirement plan. Life-insurance proceeds, muni-bond interest and veterans' benefits don't count, nor does income from a business you participate in, such as a Subchapter S or partnership.

Could the 3.8% tax apply to gains on the sale of a home?

Yes, if there is a taxable gain above the $500,000 ($250,000, single) exclusion for gains on the sale of your residence.

Example: John and Jill, who bought their home in a New York suburb for $50,000 in 1972, sell it in 2013 for $1 million. After subtracting the $50,000 cost and $500,000 exclusion, they have investment income of $450,000. If they also have a taxable IRA payout of $70,000 and a pension of $30,000, they would owe the tax of $11,400 on $300,000.

What happens if a taxpayer who owes the new tax on investments also has a large itemized deduction—say, medical expenses or a theft loss?

Even if taxable income is zero because of deductions, he or she could still owe the 3.8% tax. Example: Myra is a single filer with investment income of $100,000 and wages of $200,000. But during the same year she loses $300,000 in a Ponzi scheme. She pays no income tax, but she still owes the new Medicare tax of $3,800 on her net investment income, says Sharon Kreider, a tax expert in Sunnyvale, Calif.

Does the 3.8% tax affect trusts and estates?

Yes, and it can hit them hard. The tax is levied on investment income as low as $12,000 that isn't paid out to beneficiaries. Some believe the tax may also hit children's unearned income subject to the "kiddie tax" if the parents owe it themselves.

What steps would Law Office of Inna Fershteyn recommend to minimize these taxes, other than taking capital gains before 2013 or buying municipal bonds?

• Examine both your regular and investment income: the higher your regular AGI, the more likely that your investment income will be subject to the new tax. So while Social Security and pensions don't count as investment income, they raise AGI. This makes Roth IRA conversions even more attractive for many. "Roth withdrawals don't raise AGI and aren't investment income," says Vern Hoven, a tax expert in Gig Harbor, Wash.

• Reconsider a defined-benefit pension if you're eligible. Pension payouts don't count as investment income, and the older a taxpayer is, the more he can contribute.

• Taxpayers selling assets should consider installment sales,if spreading out the income would minimize the new tax.

• For some, life insurance may become more attractive. Because life-insurance proceeds at death aren't subject to this tax, a taxpayer could buy a policy, borrow from it and settle up at death, avoiding income tax on investment gains within the policy. But Mr. Nash cautions that the savings must outweigh the fees and other disadvantages such policies may have.

Several personal finance books aimed at women landed in my mailbox recently. They were hard to miss. The books had pink covers and the catchy, if cringeworthy, titles, “Shoo, Jimmy Choo!” and “Hot (Broke) Messes.” And then there was the one I found on Amazon, “A Purse of Your Own.”

The titles may seem better suited for the cover of Glamour magazine. But that doesn’t mean women don’t face special financial challenges. Women live longer, earn less and take more breaks from the workplace to care for children and elderly parents. And though studies show that women tend to save a slightly higher percentage of their paychecks then men, they ultimately end up with smaller balances because of their lower earnings.

ESTATE TAX JACKPOT 2010 - Oil Magnate’s Death Costs U.S. Millions in Foregone Taxes

When rich people pass away, they often get prominent obituaries. This year, they will get special arbituary - compliments of the 2010 estate tax!

As readers of my blog know, the estate tax expired at the end of 2009 and will take the year off before coming back in 2011. That means wealthy people who pass away in 2010 don’t pay any estate tax.

So it is with extra interest that we note the death of Dan Duncan, the gas-pipeline tycoon who Forbes pegged as the 74th richest man in the world. He passed away in March at age 77. His estate was valued at an estimated $9 billion. That made him the first billionaire in this country to die without an estate tax in nearly 100 years.

It also means the U.S. just lost out on millions of dollars in foregone revenue because no estate tax was in place. All because Congress couldn’t agree on a new estate tax.

Nobody in Congress really expected a billionaire of Dan Duncan’s caliber to die this year without significant estate protection already in place. In fact, the Congressional Joint Committee on Taxation estimated last year that restoring the estate tax at 2009 levels would have only added about $468 million to the federal government’s 2010 revenue.

Of course, it is highly unlikely that Mr. Duncan was going to leave his entire $9 billion estate subject to the tax. He was a big philanthropist and most likely had bequests to charity in his will.

I think that if his advisors were up to the job, the bulk of his remaining wealth was probably held in irrevocable trust or tax shelter entities. Still, he did have hundreds of millions of dollars tied up in businesses, so that could have been taxed.

For all my readers out there - do your ESTATE PLANNING now! It doesn't look like you will get a windfall of 2010 and I feel that next year the exemption on Estate Tax will go back to the initial $1 million mark.

EVER since Betty Friedan urged women to leave the house and pursue careers, people have argued over whether women’s marriages and romantic prospects would suffer for it. Was a financially successful woman a threat to her husband or a relief?

Last week, a report from the Pew Research Center about what it called “the rise of wives” revived the debate. Based on a study of Census data, Pew found that in nearly a third of marriages, the wife is better educated than her husband. And though men, over all, still earn more than women, wives are now the primary breadwinner in 22 percent of couples, up from 7 percent in 1970.

Dying 13 hrs. too soon cost $3 mil in taxes

If Fritz Lohman had only known, he would have waited another 13 hours to kick the bucket.

Lohman, 87, a SoHo real-estate magnate who pioneered the exhibition of gay art, died at home at about 11 a.m. on New Year's Eve after a long illness.

If he had instead passed away after midnight Jan.1, his partner of 48 years could have avoided paying at least $3 million in estate taxes -- thanks to Congress letting that levy lapse for 2010.

"He would probably say, 'Why didn't they tell me? I could have waited another day,' " said Charles Leslie, 76, Lohman's business and life partner -- and the sole beneficiary to his $10 million estate. "It's so utterly ludicrous," Leslie said. "You think you've done everything right, taken every precaution, and then by some congressional fiat your life turns upside down."

"What a difference a day makes -- literally," added Leslie's estate lawyer, Erica Bell.

Bell and others are shocked that Congress failed by the end of 2009 to extend the "death tax" in 2010 for the richest Americans. The rate is 45 percent of assets beyond the first $3.5 million.

Under current law, the estate tax is gone for one year, but will be reinstated -- and raised -- in 2011 for beneficiaries of more than $1 million.

"That means, if you have a choice and someone is probably going to die soon, it would be better this year than next," Bell said. "The joke is, 'Throw momma from the train.' "

She added, "This is not good public policy. There's something really wrong with a tax law that suggests when it's good to die."

But that dilemma tormented another New York family whose wealthy mother was terminally ill in December.

"The family could have put her on aggressive, artificial life support, with tubes and medical devices, until January 1, thereby saving $3 million in federal estate taxes," a source said. "The family chose the kinder path -- letting her die naturally and peacefully." She didn't make it to New Year's Day.

Leslie said his tax bills may force him to sell some of the SoHo commercial properties he and Lohman bought years ago, investments that made them a fortune. The debonair Lohman also ran a high-end interior decorating business.

Leslie is stoic about the irony of the timing of Lohman's death.

"You can't second guess things like that. We do not happen to life -- life happens to us."

And the second issue to discuss is “ Medicaid for millionaires” -

The health bills passed in Congress will prohibit states from using "asset tests" to screen people applying for Medicaid -- which critics charge will enable those with yachts and million-dollar properties to get taxpayer-financed medical coverage.

The more lax rules -- which New York put in place on its own Jan. 1 -- require applicants for public health insurance to provide only proof of income, not other assets.

"This is a screening system that is going to be fraught with abuse and fraud. You have no finger imaging, no photo identification card, and now no asset test," said state Sen. Martin Golden (R-Brooklyn).

Other critics say the new policy will drive up health-care costs.

"It's an abuse of the taxpayers' generosity . . . If somebody has a million dollars of assets, why wouldn't we expect them to use their own assets before they ask their neighbors to pay their health-care bill?" said Dennis Smith, policy adviser with the Heritage Foundation, a conservative think tank.

Paterson and other Democrats claim stricter asset tests unnecessarily impede access.

The changes have made "applying for benefits less onerous for struggling families and local governments," said Paterson spokesman Peter Kauffmann.

Beagy Zielinski is a German-born 28-year-old stylist who moved to New York to study fashion in 1995 and stayed. Just before Christmas, she broke up with her blue-collar boyfriend, who repaired Navy ships.

"He was extremely insecure about my career and how successful I am," Ms. Zielinski said.

An analysis of census data to be released Tuesday by the Pew Research Center found that she and countless women like her are victims of a role reversal that is profoundly affecting the pool of potential marriage partners.

"Men now are increasingly likely to marry wives with more education and income than they have, and the reverse is true for women," said Paul Fucito, spokesman for the Pew Center. "In recent decades, with the rise of well-paid working wives, the economic gains of marriage have been a greater benefit for men."

И хотя со временем он проходит, но Америка не успела: Барак Обама стал президентом, а его политическая молодость (вернее, инфантильность) может привести к такому же результату, как у Джона Кеннеди, который тоже был очень обаятелен и улыбчив, до самой смерти считался мальчишкой, своими студенческо-фестивальными повадками убедил Хрущева в том, что он слабак, и Хрущев поволок ракеты на Кубу (теперь уже и Фидель заявляет, что они были ему совсем не нужны).

Инфантильность Кеннеди вылилась в Карибский кризис, и мир только чудом уцелел. Путин же "отцам-иезуитам вполне достойный сын" (Нателла Болтянская), и хватка у него железная. Использовать Барака Обаму, жалующегося на американскую демократию в полутоталитарной Москве, для него плевое дело. К беде неопытность ведет, и не только в пределах Татьяниной девичьей судьбы.

Говорила я американцам: выбирайте Маккейна, старый президент борозды не испортит. Маккейн пожил на свете, сражался с красными, был в плену, умирал, страдал, ненавидел, знает, почем фунт лиха и какая это лживая дешевка - разрядка, когда речь идет о братании с режимами, не признающими западные, то есть общечеловеческие ценности. С одним Гарвардом в багаже в президенты лучше не ходить.

Америка - единственный в мире хранитель западных ценностей, а ее президент - страж. Воин. Не популяризатор, не массовик-затейник. Да и какие американские ценности мог популяризировать Обама, равнодушно прошедший мимо клетки, где томятся Лебедев и Ходорковский, и мимо суда, где пытаются дать срок Андрею Ерофееву и Юрию Самодурову за организацию художественной выставки? Закон о защите свободы такого поведения американского истеблишмента не предусматривает.

Можно, конечно, как Никсон (и не в Уотергейте дело, Бог с ним, с Уотергейтом): обменять на страшный, жестокий, тоталитарный Китай демократический Тайвань, лишив демократию места в ООН и отдав его маоистам. За лишнюю пару кроссовок (хотя их и на Тайване сделать можно), за лишний доллар инвестиций.

По-моему, это худший вид коррупции. Лучше украсть половину госбюджета, чем выбирать Зло, делать союз со Злом содержанием американской политики и уменьшать в мире количество Добра (а потом посылать на борьбу с этим Злом авианосцы и морских пехотинцев). Себе дороже. Что теперь будет с Грузией (крейсер в Батуми зашел, это явно с подачи Конгресса и тамошних республиканцев; слава Богу, это США, и президент там не диктатор) и Ходорковским?

Как это у Толстого в "Царе Федоре Иоанновиче" сказано про перезагрузку отношений Шуйского и Годунова - когда Годунов стал арестовывать (после примирения) сторонников Шуйских? "Вы нашими миритесь головами". И как унизил Обама российских демократов Владимира Рыжкова, Гарри Каспарова и Бориса Немцова! Посадил сторонников американских ценностей, защитников и сторонников США рядом с кремлевскими холуями типа Леонида Гозмана или врагами США (такими, как Сергей Митрохин из "Яблока", коммунистами, "Справедливой Россией")... Борис Немцов напомнил Обаме про то, что в бытность свою сенатором он подписывал вместе с Маккейном резолюцию в защиту Ходорковского. Ах, где же снег былых времен?

Борис Немцов вообще пошел на этот недостойный сходняк в надежде защитить Ходорковского. Увы, Обаме на это наплевать. И на других заключенных тоже. Это вам не Рональд Рейган, назвавший СССР "империей зла". Это вам не Джимми Картер, зачитывавший Конгрессу список советских политзаключенных. Обама приехал "договорчики с большевиками подписывать". И кто сказал, что демократы больше республиканцев радеют за гражданские права и права человека? Демократы Рузвельта сидели дипломатами в Третьем рейхе после оккупации Чехословакии, после Хрустальной ночи, после начала Второй мировой войны. До 1941 года. До Перл-Харбора. Пока американские солдаты не погибли из-за трусости и подлости американских политиков. Зато потом демократу Трумэну пришлось бросать на Хиросиму и Нагасаки атомную бомбу: другого выхода не осталось.

Да, не получилось у Обамы veni, vidi, vici. Он пришел, ничего не увидел и проиграл чекистам этот баскетбол. Это мы, а не Обама защищаем в России вечные американские ценности. Это мы, а не он и не его левые советники готовы отдать за них жизнь. Дай Бог миру и Америке пережить Обаму с его дешевым шоу-бизнесом, на который он разменял вечные идеалы свободы. Надеюсь, американцы увидят, услышат и не простят.

Dear all, I have to forward this video to all of you - it’s very inspirational. Considering I just visited Yad Vashem in Israel with American Jewish Committee, this hit right at home.

My mom saw this video and decided to show it to all of her 5-8 grade classes at Manhattan Beach Yeshivah… I didn’t show it yet to my kids – I will save it until they get a bit older. However we can all learn from this incredible survival story and realize the value of EACH life that someone saves…
